All states have provided for this powerful statutory remedy to assist general contractors, subcontractors, material suppliers, architects, engineers and any tradesman in collecting for the work performed on construction projects. These situations arise when the owner fails to pay the general contractor and/or the general contractor fails to pay the subcontractors.
The mechanics lien acts allow lien claimants to place a lien against the property. This ensures that the property cannot be sold without first addressing the payment due to the lien claimant. The statutes further provide that lien claimants may file suits to foreclose on their mechanics liens, which can result in the judicial sale of the property in order to pay the lien claimants.
In order to qualify for this unique remedy, the lien claimant must enhance the value to the property. One cannot file a mechanics lien merely because the party who breached a contract happens to own real estate. The lien claimant must have provided goods or services which were used to enhance the value of the property.
